Trope theory is a leading metaphysical theory in analytic ontology. One of its classic statements is found in the work of Donald C. Williams who argued that tropes qua abstract particulars are the very alphabet of being. The concept of an abstract particular has been repeatedly attacked in the literature. Opponents and proponents of trope theory alike have levelled their criticisms at the abstractness of tropes and the associated act of abstraction. In this paper I defend the concept of a (...) trope qua abstract particular by rejecting arguments that purport to show that tropes should not be understood as abstract and by arguing that the abstractness of tropes plays an indispensable role in one of our more promising trope-theoretic analyses of universals and of concrete objects. The concept of instantiation is realized differently across a variety of metaphysical theories. A certain realization of the concept in a given theory depends on what roles are specified and associated with the concept and its corresponding term as well as what entities are suited to fill those roles. In this paper, the classic realization of the concept of instantiation in a one-category ontology of abstract particulars or tropes is articulated in a novel way and defended against unaddressed objections.

The four short works in Untimely Meditations were published by Nietzsche between 1873 and 1876.They deal with such broad topics as the relationship between popular and genuine culture, strategies for cultural reform, the task of philosophy, the nature of education, and the relationship between art, science and life. They also include Nietzsche's earliest statement of his own understanding of human selfhood as a process of endlessly 'becoming who one is'. As Daniel Breazeale shows in his introduction to this new edition (...) of R. J. Hollingdale's translation of the essays, these four early texts are key documents for understanding the development of Nietzsche's thought and clearly anticipate many of the themes of his later writings. Nietzsche himself always cherished his Untimely Meditations and believed that they provide valuable evidence of his 'becoming and self-overcoming' and constitute a 'public pledge' concerning his own distinctive task as a philosopher. This article presents the new German law on advance directives from 1 September 2009. The history of the parliamentary process of this law is described, the present regulations are explained, their relevance for medical practice discussed and shortcomings are identified. Finally, the new law is compared with other regulations in the international context. Previously established legal practice in Germany has now become largely confirmed by the new law: An advanced directive must be respected in any decision concerning medical treatment, regardless (...) of the stage of the illness. It can be informally revoked at any time, even with limited decision-making capacity. Nobody may be obliged to issue a directive in any way. Advance directives do not need notarisation or routine updating after certain time intervals. Provided that the patient, who is no longer mentally competent, has issued a lasting power of attorney, or provided that the patient has been appointed a healthcare proxy by the courts, this authorised surrogate must assert the patient's will. The role of the guardianship court is clarified: it only needs to be involved in cases of disagreement as to the patient's will. The new German law thus combines more legal certainty with a liberal emphasis on patient autonomy and flexible, adaptable regulations. (shrink)

In this chapter, we introduce the perennial and sometimes sprawling topic of properties, with a brief historical sketch from Ancient to Modern philosophy throughout various cultures and traditions. We argue that the importance of properties can be shown by explaining what explanatory work they can do in philosophical theorising across many areas of philosophy. The chapters in this volume do just that in their specific ways. Samuel Alexander was a central figure of the new wave of realism that swept across the English-speaking world in the early twentieth century. His Space, Time, and Deity (1920a, 1920b) was taken to be the official statement of realism as a metaphysical system. But many historians of philosophy are quick to point out the idealist streak in Alexander’s thought. After all, as a student he was trained at Oxford in the late 1870s and early 1880s as British Idealism was beginning (...) to flourish. This naturally had some effect on his philosophical outlook and it is said that his early work is overtly idealist. In this paper I examine his neglected and understudied reactions to British Idealism in the 1880s. I argue that Alexander was not an idealist during this period and should not be considered as part of the British Idealist tradition, philosophically speaking. (shrink)

One of the more obscure arguments for Rawls’ difference principle dubbed ‘the Pareto argument for inequality’ has been criticised by G. A. Cohen (1995, 2008) as being inconsistent. In this paper, we examine and clarify the Pareto argument in detail and argue (1) that justification for the Pareto principles derives from rational selfinterest and thus the Pareto principles ought to be understood as conditions of individual rationality, (2) that the Pareto argument is not inconsistent, contra Cohen, and (3) that the (...) kind of bargaining model required to arrive at the particular unequal distribution that the difference principle picks out is a model that is not based on bargaining according to one’s threat advantage. Emotional intelligence can be comprehensively redefined based on the componential emotion approach. The componential emotion approach defines emotions as processes that are elicited by goal-relevant situations and that consist of an interplay between appraisals, action tendencies, bodily reactions, expressions, and feelings. Within the componential emotion approach, emotional intelligence can be redefined as the ability to identify emotions based on information from one or more of the five emotion components, to understand emotions in terms of the likely appraisals, action tendencies, bodily (...) reactions, expressions, and feelings that are elicited by goal-relevant situations, and to know how to regulate emotions by modifying one or more of these five components. Is it remarkable that the Royal Dutch Medical Association as a medical professional organization has the point of view that in particular circumstances euthanasia is an acceptable act for a physician. Seen from the viewpoints in the international community, we might say that it is highly remarkable. Frankly put: the RDMA has met strong international disapproval of its standpoint on euthanasia during the last 10 years or so. For instance, the World Medical Association still condemns physicians performing euthanasia as “unethical.” (...) So far the RDMA is the only professional medical organization that holds the view that in particular cases euthanasia is morally acceptable. However, viewed within the context of Dutch society, the Dutch system of healthcare, and the sociocultural approach to moral questions in The Netherlands, the RDMA point of view ceases to be reprehensible. How do physicians handle informing patients of their diagnoses and how much information do patients really want? How do registered nurses view both sides of this question? Three questionnaires were constructed and administered in a mid-size hospital in New York state. Physicians and nurses underestimate the number of patients who want detailed information. Patients who earn more than average, have a college education, and who are under age 60 are more likely to want information, and state that their physician should (...) give it to them. Only 42% of physicians state that patients want a detailed description of their diagnosis and treatment options. Physicians educated outside the USA appeared to be more likely to change their criteria for informing patients and, along with American-educated nurses, were more willing to participate in formal discussions of the issue. Physicians should comply with the wishes of patients for information and include them in the team deciding on diagnosis and treatment. (shrink)

David Lewis is typically interpreted as a class nominalist. One consequence of class nominalism, which he embraced, is that the reduction of ordered pairs, triples, etc to unordered sets of sets is conventional. The reaction by his Australian counterparts D.M. Armstrong and Peter Forrest was that Lewis was not being ontologically serious. This chapter evaluates this debate over serious ontology. It is argued that in one sense Lewis is ontologically serious, but that his additional commitment to structuralism about classes should (...) push him to adopt a trope-theoretic account of naturalness, which opens up another way to respond to the charge of not doing serious ontology. This conclusion is supported by certain remarks he makes in his correspondence, thus revealing how his thinking about properties appears to have evolved from property-egalitarianism to a sparse theory of tropes. This chapter by Fisher continues the theme of the relation between Armstrong and Lewis, only Fisher casts the net far wider. He begins by arguing that there were at least two different lines of influence from early twentieth-century behaviourism to the identity theory: one through logical positivism and the other through ordinary language philosophy, the latter involving Place and Smart, and Lewis and Armstrong. It was Armstrong and Lewis who were to have a profound influence on subsequent developments in analytic (...) philosophy, both methodologically and in metaphysics, and it is for this reason that Fisher devotes the rest of his chapter to tracing the origins of their theories of mind and the manner in which the emphases and methodologies deployed in developing their respective theories became the hallmarks of their wider impact on analytic philosophy. There has been a long tradition of characterizing man as the animal that is capable of propositional language. However, the remarkable ability of using pictures also only belongs to human beings. Both faculties however depend conceptually on the ability to refer to absent situations by means of sign acts called 'context building'. The paper investigates the combined roles of quasi-pictorial sign acts and proto-assertive sign acts in the situation of initial context building, which, in the context of “concept-genetic” considerations, aims (...) for a philosophical explanation of the anthropological functon of pictures and their relation to imagination. Background: Increasing interest in empirical ethics has enhanced understanding of healthcare professionals’ ethical problems and attendant decision-making. A four-stage decision-making model involving ethical attention, reasoning, intention and action offers further insights into how more than reasoning alone may contribute to decision-making.Aims: To explore how the four-stage model can increase understanding of decision-making in healthcare and describe the decision-making of an under-researched professional group.Methods: 23 purposively sampled UK community pharmacists were asked, in semi-structured interviews, to describe ethical problems in their work (...) and how they were resolved. Framework analysis of transcribed interviews utilised the four decision-making stages, together with constant comparative methods and deviant-case analysis.Results: Pharmacists were often inattentive and constructed problems in legal terms. Ethical reasoning was limited, but examples of appeals to consequences, the golden rule, religious faith and common-sense experience emerged. Ethical intention was compromised by frequent concern about legal prosecution. Ethical inaction was common, typified by pharmacists’ failure to report healthcare professionals’ bad practices, and ethical passivity emerged to describe these negative examples of the four decision-making stages. Pharmacists occasionally described more ethically active decision-making, but this often involved ethical uncertainty.Discussion: The four decision-making stages are a useful tool in considering how healthcare professionals try to resolve ethical problems in practice. They reveal processes often ignored in normative theories, and their recognition and the emergence of ethical passivity indicates the complexity of decision-making in practice. Ethical passivity may be deleterious to patients’ welfare, and concerns emerge about improving pharmacists’ ethical training and promoting ethical awareness and responsibility. (shrink)
